Supreme Court: Police Use of Force Judged on Entire Encounter

What the Supreme Court Just Decided About Police Brutality

On May 15, 2025, the United States Supreme Court made a major ruling in a case involving police use of deadly force. The case, Barnes v. Felix, involved a young man, Ashtian Barnes, who was fatally shot by a police officer during a traffic stop. The officer said he acted in self-defense during the final two seconds of the encounter.

But the Court said that’s not enough.

The justices ruled unanimously that courts must look at the entire situation—not just the moment the officer pulled the trigger. This decision changes how future police brutality cases will be reviewed in court.

What Happened in the Case?

Officer Roberto Felix stopped Barnes for a suspected toll violation. Barnes cooperated at first, but when the officer asked him to get out of the car, he restarted the engine. The officer jumped onto the car’s side and fired two shots into the vehicle. Barnes died from the gunfire.

The officer claimed he feared for his life in those last two seconds. Lower courts agreed and ruled in his favor.

But the Supreme Court said that’s the wrong way to look at things.

Why This Decision Matters

The Court said that police use of force must be judged based on the “totality of the circumstances.” That means judges have to look at what led up to the shooting—not just the moment it happened.

For example:

  • Why was the person pulled over?
  • What did the officer and driver say or do before the shooting?
  • Did the officer create a risky situation that made violence more likely?

This ruling is important for victims of excessive force. It ensures that their full story—not just a tiny part of it—gets told in court.

What This Means for Victims of Excessive Force

If you or a loved one has been injured or killed during a police encounter, this ruling could change your legal options. The law now says courts must look at the whole picture, including any actions the officer took before using force.

This makes it easier to hold law enforcement accountable when they cross the line.

What Our Clients Say

I was referred to Andrew Traub by a friend and am so glad! I could not have been more "taken care of" than what he did! He is knowledgeable and able to explain the legal-ese of my case to me in layman's terms and worked with me while I was out of town at a relative's home recovering from an accident. And he has loads of patience -- I had LOTS of questions, and sometimes repeated the same question -- and he answered all of them professionally and politely! We did most communications via email with a phone call here and there. He resolved my case VERY satisfactorily. I HIGHLY! recommend The Traub Law Office / Austin Accident Lawyer! If there was a way to give *10* stars out of 5, I would. Thank you Andrew Traub!
